This week’s New Yorker article regarding abuse of civil forfeiture penalties is a real eye-opener. Civil forfeiture is a form of confiscation of assets by the state, pursuant to law. It typically involves the alleged proceeds or instrumentalities of a crime.

The author of the article relates some of the most shocking abuses of civil forfeiture penalties I have ever seen described in print. Frankly, this stuff is right out of the movies and definitely worth a read. The behavior is essentially highway robbery of innocent people by the police. Texas, Arkansas, Pennsylvania, and Georgia are some of the states highlighted where the abuses have been most glaring, but as you can imagine, this could be happening in plenty of other small towns and cities as well.
